Tutza User Agreement

1. Agreement

When you use Tutza services, you are entering into a legal agreement and you agree to all of these terms.
You agree that by clicking “Join Now”, “Sign Up” or similar, registering, accessing or using our services, you are entering into a legally binding agreement.
This “Agreement” includes this User Agreement and other terms that will be displayed to you at the time you first use certain features. If you do not agree to this Agreement, do NOT click “Join Now” (or similar) and do not access or otherwise use any of our Services.

2. Obligations

To use this Tutza Service, you agree that:

  1. You must be the “Minimum Age” (18) or older
  2. You will keep your password secure and confidential
  3. You will follow the law and Tutza agreement. You are responsible for anything that happens through your account unless you close it or report misuse.
  4. You will honor your payment obligations where applicable.
  5. You agree that we may provide notices to you in the following ways:
    1. A banner notice on the Service, or
    2. An email sent to an address you provided, or
    3. Through other means including mobile number, telephone, or mail.
  6. You agree to keep your contact information up to date.
  7. By using Tutza services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. You agree that we (Tutza) are not responsible for third parties’ (including other Members’) content or information or for any damages as result of your use of or reliance on it.
  8. You agree that Tutza do not guarantee that the services will function without interruption or errors.
  9. Tutza can end this Agreement anytime we want.
  10. In the unlikely event we end up in a legal dispute, it will take place in United Kingdom courts, applying United Kingdom law.
  11. Tutza reserve the right to change the terms of this Agreement and will provide you notice if we do and we agree that changes cannot be retroactive. If you don’t agree to these changes, you must stop using Tutza services.
  12. You will not copy, rip or capture, or attempt to copy, rip or capture, any content from the service or any part of the service, other than by means of download in circumstances where the relevant Uploader has enabled the download functionality with respect to the relevant item of Content.
  13. You will not adapt, copy, republish, make available or otherwise communicate to the public, display, perform, transfer, share, distribute or otherwise use or exploit any Content on or from the service.
  14. You will not employ scraping or similar techniques to aggregate, repurpose, republish or otherwise make use of any content.
  15. You will not:
    1. Act dishonestly or unlawfully, including by posting inappropriate, inaccurate, or objectionable content;
    2. Create a false identity;
    3. Create a Member profile for anyone other than yourself (real person);
    4. Use or attempt to use another’s account;
    5. Harass, abuse or harm another person;
    6. Send spam or other unwelcomed communications to others;
    7. Scrape or copy profiles and information of others through any means;
    8. Act in an unlawful, libelous, abusive, obscene, racist, sexist, , discriminatory or otherwise objectionable manner or illegal acts that my promote terrorism, violence or act in a way deemed inappropriate to Tutza’s reasonable judgement.
    9. Upload any content that you do not have complete copyright control of.

Tutza Artist Agreement


When you use Tutza services, you are entering into a legal agreement and you agree to all of these terms.
You agree that by clicking “Join Now”, “Sign Up” or similar, registering, accessing or using our services, you are entering into a legally binding agreement.
This “Agreement” includes this User Agreement and other terms that will be displayed to you at the time you first use certain features. If you do not agree to this Agreement, do NOT click “Join Now”, “Sign Up” or “Upload” (or similar) and do not access or otherwise use any of our Services.

By joining and/or uploading content you automatically legally adhere to the terms set out below.

  1. The Artist agrees to license the track to the service (Tutza) indefinitely.
  2. The region in which the service (Tutza) may distribute the Artists tracks will be worldwide.
  3. The Artist agrees that there are no samples in the tracks in question which is due to be licensed that they have may be liable for. If there is and at a later date any action is taken due to this form of wrong-doing then the artist shall be held full responsible.
  4. The service (Tutza) shall pay to the Artist(s) a royalty percentage of 50% , of the net amount of fund received from the sale of the Work. The service (Tutza) shall pay the royalty to the Artist(s) quarterly when the Artist(s) has raised a royalty over (£50). If payment due to Artist(s) is not at least equivalent to UK£50, it will be rolled over into successive accounting periods until payment due exceeds the equivalent of UK£50.
  5. The Artist agrees that the content they upload, and each and every part thereof, is an original work by you, or you have obtained all rights, licenses, consents and permissions necessary in order to use, and (if and where relevant) to authorise Tutza to use, your content pursuant to these Terms of Use, including, without limitation, the right to upload, reproduce, store, transmit, distribute, share, publicly display, publicly perform, make available and otherwise communicate to the public Your Content, and each and every part thereof, on, through or via the Website, any and all Services and any Linked Services.
  6. The content and the availability thereof on the Platform does not and will not infringe or violate the rights of any third party, including, without limitation, any intellectual property rights, performers’ rights, rights of privacy or publicity, or rights in confidential information.
  7. The content, including any comments that you may post on the Tutza service, is not and will not be offensive, abusive, libellous, defamatory, obscene, racist, sexually explicit, ethnically or culturally offensive, indecent, will not promote violence, terrorism, or illegal acts, or incite hatred on grounds of race, gender, religion or sexual orientation.
  8. You have obtained any and all necessary consents, permissions and/or releases from any and all persons appearing in your content in order to include their name, voice, performance or likeness in your content and to publish the same on the Tutza service and via any Linked Services.
  9. You are solely responsible for all of your content that you upload, post or distribute to, on or through the Tutza service, and to the extent permissible by law, Tutza excludes all liability with respect to all content (including your content) and the activities of its users with respect thereto.

The type of information collected by Tutza

The type of information collected by TUTZA is either information of a personal nature that you supply to us (such as your name address, email address, telephone number, company name etc), when you create an account, request for information, services and / or support, participate in surveys and the like; or content submitted by users in support of TUTZA’s vision to act as a platform for the sharing and exchange of information relating to the African music industry. Anonymous data collection

You may, as a matter of principle, visit the Tutza portal without telling us who you are. We are notified merely of the name of your Internet Service Provider, the website from which you accessed our site, and which of our website pages you visit. This information is evaluated for statistical purposes and you anonymity as an individual user is preserved.


We may place a “cookie” on your device. A cookie is a small amount of data, which often includes an anonymous unique identifier, sent to your browser from a website’s computers and stored on your computer’s hard drive. We may use cookies to keep track of your choice of language and home page preference and to gather usage data that will help us generally improve the quality of our Website. Should you not want us to send you cookies, there is a simple procedure in most browsers that allows you to deny or accept cookies.

Use Of IP Address

An IP address is a number that is automatically assigned to a computer whenever it is connected to the Internet.  We may collect IP addresses for the purposes of system administration and to audit the use of the Web Site. We do not link IP addresses to personal information, which means that your session may remain anonymous.  However, the Owner cannot guarantee that this will always be the case.  For example, it may be necessary to identify a particular user when it is necessary to enforce compliance with the Terms and Conditions or to protect our service website or other interests.

Personally Identifiable Information

We may collect information that can be used to identify you (Personally Identifiable Information). Please note that we only collect Personally Identifiable Information when you specifically provide it to us such as to register for our newsletter or directory, in response to a survey or when registering for personal services. You may also be asked to create a user account and provide certain information including your name, email addresses, physical address, and telephone number. When you create a user account on our website and sign in to your account, you are not anonymous to us.

Security Of Your Personal Data

We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. We will store all the personal information you provide on our secure (password- and firewall- protected) servers. Data transmission over the internet is, however, inherently insecure, and we cannot guarantee the security of data sent over the internet. You are responsible for keeping your password and user details confidential. We will not ask you for your password.

The portal contains links to other websites. We are not responsible for the privacy policies or practices of third party websites.


This Privacy Policy is effective as at 1st June 2016. We reserve the right to change this Privacy Policy at any time. We do not undertake to provide you with personal notice of any changes.
